Welcome to makemydp.in! These Terms and Conditions ("Terms") govern your use of our website and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By using the Service provided by makemydp.in, you confirm that you have read, understood, and agree to comply with these Terms. If you do not agree with any part of these terms, you must not use our Service.

2. Age Requirement

You must be at least 18 years old to use our Service. By using makemydp.in, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into this agreement. We do not knowingly collect information from or provide services to individuals under the age of 18.

3. Service Description

makemydp.in is a digital platform that uses artificial intelligence to generate personalized profile pictures ("DPs") for users based on photos they upload. The Service is provided "as is" and is intended for personal, non-commercial use.

4. User Content and Consent

  • Your Photos: To use our Service, you must upload a personal photograph ("User Content"). You are solely responsible for the User Content you upload.
  • Permissions: You represent and warrant that you own the User Content or have all necessary rights, licenses, and permissions to use it and to grant us the rights to process it as described in these Terms.
  • License to Us: By uploading your photo, you grant makemydp.in a limited, non-exclusive, worldwide, royalty-free license to use, modify, process, and reproduce your User Content solely for the purpose of generating and delivering your requested DPs. We will not use your uploaded photos for any other purpose. Your original photos are deleted from our servers after the DPs have been successfully generated and delivered.

5. Prohibited Content

You agree not to upload any User Content that:

  • Contains nudity, sexually explicit material, or is otherwise obscene.
  • Is violent, harassing, hateful, or promotes discrimination against any individual or group.
  • Infringes on any third party's intellectual property rights, including copyright and trademarks.
  • Is illegal, fraudulent, or promotes illegal activities.

We reserve the right to refuse service and terminate accounts for users who upload prohibited content.

6. Purchases and Payments

All purchases are subject to our Pricing Policy. All payments are processed securely through our third-party payment partner, Razorpay. By making a purchase, you agree to provide accurate payment information.

7. Digital Delivery Policy

  • Method of Delivery: Your generated DPs will be delivered digitally to the email address or WhatsApp number you provide during checkout. A downloadable link may also be provided.
  • Delivery Timeframe: We aim to deliver your DPs within a few minutes of a successful transaction. However, processing times may vary due to server load or technical issues.
  • Failed Delivery: If you do not receive your DPs within a reasonable time, please first check your email's spam or junk folder. If you still cannot locate them, please contact our support team for assistance.

8. Refund Policy

Due to the automated and digital nature of our service, all sales are final. We do not offer refunds or cancellations once an order is placed and the AI generation process has begun. If you encounter a technical error resulting in a failed order, please contact our support team.

9. Intellectual Property

  • Your DPs: You own the rights to the final, generated DP images that you purchase. You are free to use them for your personal, non-commercial purposes.
  • Our Service: All rights, title, and interest in and to the Service itself (including our website, branding, text, graphics, user interface, and the underlying AI technology) are and will remain the exclusive property of makemydp.in and its licensors.

10. Limitation of Liability

To the fullest extent permitted by law, makemydp.in shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Service.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
